FSB FisherBroyles Announces Formation of Real Estate Practice With Addition of New Members

FSB FisherBroyles is pleased to announce the commencement of a Real Estate Practice with the
addition of Jeff Israel, Catherine Morgen, Damon Goode, Jeffrey Lutz, and Scot Burton to the Firm’s Atlanta office.

“We are thrilled to be adding five accomplished attorneys to kick off our Real Estate practice group,” said Kim Verska, Managing Member of FSB’s Atlanta office. “Their experience in all manner of commercial real estate transactions, as well as related areas, is a great platform on which to grow our Real Estate practice.”

According to Mr. Israel, “The timing of the start of FSB’s Real Estate Practice could not be any
better. These are trying times for real estate professionals, who are looking for legal counsel they
can count on to provide quality, timely and perhaps most importantly, reasonably priced advice and transactional legal services. FSB is perfectly positioned to provide just that.”

After launching his practice at Alston & Bird, Mr. Israel spent many years in-house as Senior
Director of Real Estate Legal for Home Depot, and more recently has been the founder and
principal of a real estate development, management and brokerage company. Ms. Morgen, Mr.
Goode and Mr. Burton join FSB from Alston & Bird, Troutman Sanders and Morris Manning &
Martin, respectively. With some 45 years’ experience among them in representing clients large and
small engaged in the acquisition, development, leasing and disposition of commercial real estate,
these four attorneys look forward to bringing their experience and skills with real estate
transactional work to market at more attractive billing rates. “Many businesses feel immense
pressure right now to reduce costs, especially legal costs,” Mr. Goode said. “Law firms, such as
FSB, that control their overhead costs have a great opportunity in this economy to offer legal
services at much more reasonable rates, while providing the service and expertise that clients
demand.”

While each of these attorneys have broad experience in the full range of transactional real estate
matters, Mr. Israel and Ms. Morgen have particular expertise representing lenders and developers
in multi-state secured lending transactions. Mr. Goode has focused on commercial development
and leasing transactions, both on behalf of landlords and tenants, in office, retail and industrial
properties. For his part, Mr. Burton’s real estate practice focuses on real estate ownership
structures, and tax issues associated with real estate transactions, especially with respect to taxexempt investors with particular ERISA and other tax concerns.

Mr. Lutz joins the firm after a successful stint as a solo practitioner, primarily in the area of real
estate-related litigation. Prior to that, he practiced at Epstein Becker & Green, P.C. “Flexibility
allowed me to grow my real property litigation and construction practice in an economy and industry where growth was not expected. With that flexibility, I was able to take nearly every client I was working for out the door.” Mr. Lutz added that he “had been looking for a platform that could
support and promote continued growth. FSB offers the best of both worlds in that I can offer my
clients an amazing depth of talent and skill sets at rates they haven’t seen in four or five years.”

FSB’s vision was formed by Kevin Broyles, James Fisher and a handful of other attorneys at a large Atlanta firm in the latter part of 2001. Their idea was to respond to client demands in a struggling economy, and to create a law firm structure that would make attorneys excited about going to work each day. Clients were looking for a more cost-effective, responsive, flexible and personable legal service solution. FSB answered these concerns by removing the costly overhead associated with traditional large firms – no more expensive office space, inexperienced attorneys, wasteful support staff, or multi-layered approach to delivering legal services. FSB aligns its perspective with that of its clients by eliminating the incentives attorneys in traditional firms have to justify skyrocketing billable rates and to stretch time to meet unrealistic billable quotas. Instead, FSB’s attorneys focus on applying practical solutions to meet client needs and chase efficiencies, not billables, as if it is their dollar (not the client’s) that is being spent.
